Terms and Conditions of the Duchenne Dash

 

This agreement (which incorporates these Terms and Conditions, the Duchenne Dash 2027 Rider Registration Form and the Duchenne Dash 2027 Medical Questionnaire) is made between:

 

(1)   Duchenne UK (“DUK”) a registered charity (charity number 1147094), whose Registered Office is located at Duchenne UK, Unit G24, Shepherd’s Building, Charecroft Way, Hammersmith, London W14 0EE.

 

And

 

(2)  You as an individual fundraiser, because you wish to participate in and raise funds for DUK in connection with the Duchenne Dash 2027 fundraising event organised by DUK (the “Event”).

 

By accepting these terms and conditions in the Duchenne Dash 2027 Rider Registration Form, you undertake and confirm as follows:

 

1.     That you are over 18 years old as proven by the submission of valid passport details. Failure to supply said details may result in Duchenne UK refusing participation in the Event. 

 

2.    You agree that this is a fundraising event, raising money for Duchenne UK, and you ensure that all sponsorship money raised is donated to Duchenne UK either by using an online platform (JustGiving) or by sending your sponsorship monies directly to Duchenne UK. Further guidance on how to pay in your sponsorship monies can be found in the Fundraising Guide.

 

3.   By signing up to join the Duchenne Dash, you have made a commitment to raise £4,200 in fundraising and donations for Duchenne UK. Please aim to raise the majority of your fundraising goal before the event, as this helps us plan and ensures the event raises the vital funds needed for Duchenne UK. Any remaining money should be covered by proof of pledges and paid to Duchenne UK within four weeks after the event. If you’re finding fundraising difficult at any point, just let us know.

 

4.    If you have failed to begin fundraising four weeks prior to the event (9th April 2026) Duchenne UK will contact you to offer fundraising support and gain insight into your plans for reaching your pledged fundraising target. If you fail to respond or indicate any positive intention to fundraise, Duchenne UK reserves the right to refuse your entry to the Duchenne Dash. In such circumstances, due to the administration time and expense we have incurred, your registration fee will not be refunded.

 

5.    Monies claimed from HMRC for Gift Aid do not count towards your fundraising total.

 

6.    The registration fee is £625 (plus a £8.50 booking fee). The booking fee includes a credit card handling fee imposed by the banks and payment acquirer. These booking charges will not be received by Duchenne UK and are non-refundable.

 

7.     You understand and agree that the registration fee is non-refundable, (including, but not limited to, in the case of withdrawal, alteration or cancellation of the Event except to the extent described in the paragraph below, or if you decide to withdraw your consent to our processing your personal information (as detailed on the medical form)). Your registration fee covers important costs incurred by Duchenne UK associated with your participation in the Event and if you withdraw from the Event or the Eventis altered or cancelled, Duchenne UK will not be able to recover all of its committed and other costs from its suppliers. When your withdrawal is acknowledged by the Duchenne UK team, you will not be liable to raise any further sponsorship. Donations already made to Duchenne UK will support our vital work even if you are unable to take part, unless a refund is requested directly by the donor. Any refunded sponsorship must be returned to the original donor(s), or may be re‑donated to Duchenne UK with its permission. We ask that you inform your donors of your change in circumstances so they can decide whether they would like their donation refunded.

 

8.   If you are unable to take on the challenge due to unforeseen illness/injury, you must let Duchenne UK know immediately. With the agreement of Duchenne UK’s Director of Income Generation, it may be possible for another person to take your place if you can no longer participate, providing they commit to raising the minimum £4,200 in sponsorship. Where a replacement is arranged, the outgoing and incoming riders typically manage the transfer of the registration fee between themselves. Duchenne UK does not reassign or amend the original registration fee payer in our systems. While we will support the administrative steps involved in transferring a place, refunds of registration fees are not guaranteed.

 

9.    Deferring your place: Should you need to withdraw, it is possible to defer your place to the following year. You may defer your place only once, to next year’s Duchenne Dash, due to take place in May 2028. If Duchenne UK agrees to defer your place to the following year, your registration fee maybe transferred at the discretion of Duchenne UK. If Duchenne UK agrees to defer your place to the following year, any monies you raise in sponsorship can be carried forward to the following year and you must inform your donors of your intention to defer.

 

10.  Event cancellation due to Covid-19: We reserve the right to cancel: (a) the Event (in whole or in part); or (b) your participation in the Event due to, or as a result of, any restrictions and/or guidance imposed by relevant authorities (such as the UK or French Governments, devolved governments, and/or local government authorities) or applicable laws relating to the Covid-19 pandemic (the “Restrictions”). We may, for example and without limitation, cancel the Event and/or your participation in the Event if, in our sole opinion, the Event and/or your participation in the Event is unlawful, unsafe, or undesirable in view of the Restrictions. If the Event is cancelled for any of the reasons described in this paragraph, then DUK will reimburse the registration fee to you as soon as isreasonably possible, the booking fee is non-refundable. For the avoidance of doubt, should you contract Covid-19 or need to self-isolate due to Covid-19 and, as a result, cannot participate in the Event, DUK shall not be obliged to refund the registration fee to you.

 

11.   Covid-19 testing for entry into events: Guidelines for Covid-19 testing for entry into mass participation events have yet to be confirmed for Summer 2027. In the event of any testing requirements being imposed by the relevant authorities (such as the UK or French Governments, devolved governments, and/or local government authorities) participants will be notified. Participants agree to comply with guidelines and requirements as specified.

 

12.   That you will complete and submit the Rider Registration and Medical Forms upon payment, or no later than Monday 1st March 2027.

 

13.   That you understand that DUK reserves the right to alter the itinerary and/or cancel the Event should climatic or any other unforeseen circumstances render this necessary.

 

14.   That you are fit enough to cover the distance of the ride and have accurately completed the Duchenne Dash 2027 Medical Questionnaire within your registration and as part of this agreement.

 

15.   That you understand that DUK reserves the right to refuse participation on medical grounds if DUK believes your safety and/or that of any other participant or person may be compromised. 

 

16.   That if you are over 75 years old, or have any sort of medical condition, which could be adversely affected by exercise (particularly a heart condition), you will obtain a medical certificate from your doctor prior to the departure date certifying that you are medically fit enough to participate in the Event without compromising your own or any other participant’s safety. DUK may request evidence of such certificate and may, at their sole discretion, refuse your participation in the Event if such evidence is not provided.

 

17.  That to the best of your knowledge, your general state of health is good and that you will inform DUK of any change in your medical condition that occurs between completing the Duchenne Dash 2027 Medical Questionnaire, and the departure date of the event.  

 

18.   You consent to receive medical treatment, which may be deemed advisable in the event of injury, accident and or illness during this Event.

 

19.   You acknowledge that the costs related to any injuries incurred throughout the Event are the responsibility of the individual participant, to the extent that they are not covered by the insurance procured by DUK.

 

20.  You understand that DUK holds public liability and event insurance for this Event, details of these insurance policies are available on request.

 

21.   You understand that insurance for bikes and personal equipment is not covered by the insurance procured by DUK and is the responsibility of the individual participant.

 

22.  You understand that at this Event or related activities, you may be photographed and/or filmed. You agree to grant DUK, the event holders, producers, sponsors and organisers permission to store and use any photo, video or film featuring yourself throughout the world in all and any media including in printed publications, presentations, promotional materials, photography exhibitions, or on the relevant party’s website.

 

23.  That you are fully responsible for your actions whilst participating in the Event and acknowledge and agree that DUK does not accept responsibility for your actions nor the consequences of such actions.

 

24.  You understand that drop handle road bikes, with standard wheels are the only bikes permitted for entry into this Event and all participants must wear cycle helmets at all times while cycling.

 

25.  You understand that you assume responsibility for the mechanical soundness of your bicycle and its parts, including but not limited to tires, gears, chain and bolts. You have examined or will examine the bicycle and certify that it is properly assembled and fit to ride.

 

26.  You understand that DUK reserves the right to refuse participation in the Event for anyone with inappropriate equipment or clothing.

 

27.  You will abide by applicable laws and the rules of the Highway Code and any equivalent rules in France, and follow the advice, direction and instruction of the event organiser, event volunteers and marshals to ensure a safe and successful event. Anyone not adhering to applicable laws, the Highway Code and any equivalent rules in France or the organiser’s rules and conditions may be removed from the Event, at the sole discretion of DUK.

 

28.  You understand that you can contact DUK via the email address: duchenne@duchenneuk.org. Should you wish to be removed from such database at any time, please let us know andwe will remove you accordingly.

 

29.  You have given DUK certain information, including medical information, about yourself and consent to DUK using such information in relation to the Event. You understand and agree that all personal information, including medical information provided on this form shall be treated in accordance with the DUK Privacy Policy, which is availableon the DUK website.

 

30.  This agreement shall be governed by English law and subject to the exclusive jurisdiction of the English courts. 

 

Limitation of Liability

DUK does not limit or exclude its liability to a greater extent than is permitted by applicable laws for (i) death or personal injury caused by its negligence; (ii) any fraud or fraudulent misrepresentation by DUK; or (iii) anything else which cannot be excluded or limited by applicable law. Subject to the preceding sentence, DUK is a charity and is conducting this Event in its capacity as a charity and as part of its fundraising efforts and therefore shall not beliable to you for any claims for any of the following: (i) loss or damage to property; (ii) personal injury or death (except where caused by DUK’s negligence); (iii) loss of profit or revenue (such as earnings); or (iii) indirect or consequential losses arising under or inconnection with this agreement or the Event.
